No indictment for deadly fall from car

PITTSFIELD, Mass. (AP) - A grand jury has declined to indict a Pittsfield man on a charge that he was responsible for the death of his wife, who hit her head on the ground after getting out of their moving car during an argument.

James Benlien still faces a drunken driving charge.

Prosecutors say Benlien and his wife, Christine, were arguing in the early morning hours of Nov. 27 as they drove home from a bar with their adult daughter. She stepped out of the vehicle, fell and hit her head. She was pronounced dead at a hospital.

Police say he then drove one-third of a mile home.

Benlien's lawyer tells the Berkshire Eagle there was no evidence to support the charge of leaving the scene of a fatal accident.
