City says it's ready to sue the state

DOT says they have every right to construct.

WEST SPRINGFIELD, Mass. (WWLP) - The City of West Springfield is gearing up for a legal battle with the state.

They say the state is violating the law with their bridge construction project on Rt. 20.

Wednesday night the city's Conservation Commission issued a cease and desist order to the state Department of Transportation.

According to them, the Wetlands Protection Act requires they obtain a special permit in order to build within 100 feet of a wetland.

Department of Transportation Spokesman Mike Verseckes told 22News they have every right to continue the project.

City Conservation Officer Mark Noonan says that shows the state is "arrogant."

The city gave the state until June 8th to comply before they take legal action.

On Monday, Mayor Greg Neffinger sent police officers to stop the construction.

The project's goal is too raise the height of the railroad bridge that carries Rt. 20 over the tracks near Charles Avenue.

Now, it's turned into an environmental battle that may end up getting decided in court.
