SPRINGFIELD, Mass. (WWLP) - Former Springfield Police Officer Jeffery Asher will hold on to his $45,000 a year pension, at least for now.
Asher was convicted last week of assault and battery charges against Melvin Jones in 2009. State law requires his pension be forfeited upon final conviction. But at a retirement board meeting Thursday night, attorneys for the board and for Asher disagreed over what final conviction means.
Attorney Kevin Coyle, of the local police union, represented Asher in court. "The entire process of the criminal prosecution should be completed including any appeals that the accused may have."
Alfredo Vivenzio, Attorney for the Springfield Retirement Board said, "Final conviction: you got the jury verdict, you got sentencing. When that's happened, it's done."
The board voted to postpone the pension vote until after Asher is sentenced March 28th. He is expected to appeal his conviction.
