SPRINGFIELD, Mass. (WWLP) - A new trial's been granted to Charles Wilhite, a Springfield man who was found guilty of murder.
Judge Peter Velis found there was no other evidence linking Wilhite to the killing of Alberto Rodriguez back in 2008 because two witnesses recanted their statements.
Wilhite's family told 22News, they are happy with the judge's decision.
"It was so much excitement, so much tears and happiness all at the same time," Sheila Drungo told 22News.
"We are very excited about that and motivated to renew our efforts to free Charles," Vira Cage told 22news.
Wilhite's attorney David Lewis told 22News, he has not seen the judge's statement yet, but the Hampden County District Attorney's office could decide to appeal the judge's decision, go ahead with a new trial, or drop the charges.
