NORTHAMPTON, Mass. (WWLP) - A lawyer for accused Northampton arsonist Anthony Baye told 22News the defense has filed a motion to dismiss the case.
Attorney David Hoose said both sides will be back in court on April 1st.
A grand jury re-indicted Baye last July for a series of arson fires that happened on December 27, 2009. Paul Yeskie, Sr. and Paul Yeskie, Jr. were killed in one of those fires, which destroyed their Fair Street home.
Hoose argues that the testimony of State Trooper Joseph Gura to the grand jury before those indictments was not backed up by evidence. Trooper Gura testified that all 27 fires were arsons committed by the same person.
Baye's lawyers are asking Judge Contance Sweeney to dismiss the case based on that and other issues.
A trial has been tentatively set for May.
