AMHERST, Mass. (WWLP) - The driver of a car that police say struck an Amherst student on Friday afternoon will not be criminally charged.
Amherst Police Lt. Ronald Young told 22News that Nikhil Kapur, 32, of Cambridge, is being cited for failure to use care when starting, and failure to stop for a school bus with flashing lights. Police say Kapur was driving on South East Street when he allegedly struck a young boy near the corner of College Street, shortly after the child got off the school bus.
Young says that Kapur is not facing charges, because in accordance with state law, the offense is not criminal. He was not believed to have been speeding at the time of the crash.
The student was taken to the hospital, but has since been released and is expected to recover. The Superintendent of Schools has provided grief counselors for students who witnessed the accident.
