A former doctor who sued Baystate Health for illegally terminating his employment was awarded nearly $2 million in compensation.  

Doctor Francis Duda claimed that Baystate Medical Practices Inc., terminated his employment in violation of Massachusetts law prohibiting discrimination in the workplace. Dr. Duda, who was diagnosed with cerebral palsy as a child, is a pediatric pulmonologist. 

Duda’s attorney, Tani Sapirstein, sent 22News a statement that read in part, “Dr. Duda treated children with severe respiratory disorders for over twenty two years at Baystate Medical Practices, Inc. The jury found that Baystate Medical Practices, Inc. terminated his employment because of his cerebral palsy and awarded Dr. Duda $772,770.08 in compensatory damages and $1,146,812.38 in punitive damages for a total of $1,919,582,46.”

In a statement to 22News on behalf of the healthcare system, Vanessa Smith, Esq., vice president and chief general counsel at Baystate Health said Baystate Health is “disappointed with the verdict. Baystate Medical Practices did not terminate Dr. Duda because of his disability or his age. We are considering our options with regard to an appeal.”
